Nordstrom will not be liable for losses incurred as a result of an unauthorized use of a password or account. 3.Merchandise Availability

Merchandise availability on our Site is not guaranteed as it may be low in stock. If merchandise is not available by the time your order processes, we will notify you of this via email. You can always verify availability by joining us in Chat. You will receive a shipping confirmation email once your items have shipped.

4.Product Description

Flormiss attempt to be as accurate as possible. However, Flormiss doesn't warrant that product descriptions, prices, given amounts or other content on Flormiss are accurate, complete, error-free, and reliable.

If you are a Flormiss employee and submit a review as part of your User Content, you must disclose your employment status within that review.

By providing User Content via the Site or Social Media Assets, you affirm, represent, and warrant that:

a) you are the creator and owner of the User Content, or have the necessary licenses, rights, consents, and permissions to authorize Flormiss and users of the Site to use and distribute your User Content as necessary to exercise the licenses granted by you in these Terms, in the manner contemplated by Flormiss, the Site, and these Terms;

c) if you are a Flormiss employee, that you have disclosed this fact in any review you have submitted; and

d) your User Content could not be deemed by a reasonable person to be objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, or otherwise inappropriate

You shall indemnify and hold harmless Flormiss and its affiliates, third parties, subsidiaries, respective officers, employees, directors, and agents from any claim, demand, actions, or penalties, including the attorneys' fees, made by any third party due to your breach of the User Agreement, Terms & Conditions Notice, rules, regulations or rights of the third party.

14.Force Majeure

Flormiss shall have no liability to you for any interruption or delay in the access to websites, mobile sites, or applications, irrespective of any cause.

15.Arbitration

If any dispute arises between you and Flormiss in connection with validity, interpretation, implementation, or alleged breach of any provision of the User Agreement and/or Terms & Conditions Notice, said dispute shall first be referred to a sole arbitrator who shall be an independent and neutral third party identified by Flormiss.

16.Applicable law

These Terms of Service and any separate agreements whereby we provide you shall be governed by and construed in accordance with the laws of France.

17.Sales, Customs and Value-Added Taxes

In an effort to remain compliant with respective consumer legislation, we strongly encourage our customers to maintain good standing with respect to custom and value-added taxes or VAT, where applicable.

Due to separate and applicable tax jurisdictions, the end customers' purchases may be subject to specific sales, custom or VAT, and the shipping time and associated cost may increase.

This Site may include links to other websites maintained by third parties ("Linked Sites"). Flormiss provides Linked Sites to you solely as a convenience, and the inclusion of Linked Sites does not imply endorsement by Flormiss of the Linked Sites. Linked Sites are not under the control of Flormissand Flormiss is not responsible for the contents of any Linked Site.

19.No Soliciting or Spamming

You agree not to use the Site to advertise, or to solicit anyone to buy or sell, products or services, nor to solicit anyone to make donations of any kind, without our express written approval.

From time to time, users post their email addresses in our chat rooms, forums, blogs, and other public posting areas. You may not gather these email addresses for commercial or illegal purposes, such as sending unsolicited or unrequested emails or instant messages.

These Terms constitute an agreement that is effective unless and until terminated by Flormiss. Flormissmay, at its sole discretion, terminate these Terms or your Account on the Site, or suspend or terminate your access to the Site, at any time for any reason or no reason, with or without notice. You may terminate your Account at any time by contacting Flormiss customer service. If in Flormiss's sole discretion you fail to comply with any term or provision of these Terms, Flormiss may terminate your Account and deny you access to the Site.

21.Other

No waiver of any provisions in these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision.

Additionally, if any provision of these Terms of Use is found to be void, unlawful or unenforceable for any reason, that portion shall be deemed severable from these terms and shall not otherwise affect the validity and enforceability of any remaining provisions.

Flormissenters into this Agreement on its own behalf and on behalf of each of its worldwide affiliates. Accordingly, Flormiss holds the benefit of and may enforce this Agreement on behalf of those affiliates. Flormissreserves the right to pursue any remedy available to it at law or in equity if you breach this Agreement.
